Digital nomad visa vs non-lucrative visa: which one?

If you do any remote work, the non-lucrative visa is not an option. A decision guide for Americans choosing between Spain's DNV and the NLV in 2026.

The trap for early retirees and FIRE applicants

People with enough investment income to live on often gravitate to the non-lucrative visa because the paperwork looks simpler and the income can come from a portfolio. The problem arrives when they keep a couple of consulting clients, run a small online business, or write a paid newsletter.

The non-lucrative visa prohibits professional activity. It does not prohibit "working in Spain for Spanish companies" — it prohibits work. Doing remote work for a US client while holding an NLV puts your permit and your renewal at risk. If you intend to do any of it, the DNV is the correct route even where your passive income alone would satisfy the NLV.

The honest test is not "how much do I work?" but "will I do any paid work at all?". If the answer is anything other than a clean no, plan on the DNV.

When the NLV is genuinely the better answer

Worth knowing: the NLV has no equivalent of the Beckham Law, so an NLV holder is taxed under the ordinary progressive regime on worldwide income. For a high-income household that difference can outweigh the simpler application.

What about the Golden Visa?

It no longer exists. The residence-by-investment route was repealed by Ley Orgánica 1/2025 and ceased to be available on 3 April 2025. Buying property in Spain today has no immigration effect whatsoever, and any page still presenting it as a live option is out of date.

Which is better for an early retiree, the DNV or the NLV?

If you will do no paid work at all, the non-lucrative visa fits and needs around €2,400 a month in passive income. If you intend to keep any consulting, freelancing or online business activity, the non-lucrative visa is not available to you and the digital nomad visa is the correct route.

Can I work remotely on the non-lucrative visa?

No. The NLV prohibits professional activity, and that includes remote work for clients or employers outside Spain. This is the single most common and most costly misunderstanding about the visa.

Can I convert an NLV into a digital nomad permit?

Not from inside Spain under current practice. Choosing the wrong route is therefore harder to undo than people assume, which is why the decision is worth getting right before filing.

Does buying property in Spain get me residency?

No. The Golden Visa was repealed by Ley Orgánica 1/2025 and ended on 3 April 2025. There is currently no residence-by-property-investment route in Spain.

Do both visas count towards permanent residency and citizenship?

Yes. Both are legal residence permits, so time held under either counts towards long-term residency after five years and towards naturalisation — ten years in the general case, two for nationals of Ibero-American countries and several other groups.
